The UK spouse visa, also known as the partner and spouse visa, allows eligible foreign nationals to join and reside with their partner in the UK, provided their partner is a British citizen or settled person (such as someone with Indefinite Leave to Remain or EU Settled Status). Marriage to a British citizen does not automatically grant the right to live in the UK; applicants must apply for a Spouse Visa. Eligible applicants include those who are married, in a civil partnership, or unmarried.
To apply, the partner based in the UK must be a British or Irish citizen, have settled status, refugee status, humanitarian protection, or certain visas. Applicants must also intend to live together in the UK and provide evidence of a genuine and subsisting relationship.
The partner and spouse visa is initially granted for up to 2 years and 9 months, with the possibility of extending stay and eventually acquiring Indefinite Leave to Remain (ILR), granting permanent residency in the UK. After obtaining ILR, applicants may be eligible to apply for British citizenship by marriage.
